1. Agreement to Terms

By downloading, installing, or using the MakeWeight mobile application ("App"), operated by LabCabin LLC, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, do not use the App.

2. Description of Service

MakeWeight is an iOS application designed to help wrestlers safely manage their weight using:

• NCAA-compliant weight tracking and minimum wrestling weight calculations
• Phase-based protocol guidance (baseline, water loading, gut cut, water taper, restriction, recovery)
• AI-powered coaching and personalized meal plans
• Hydration, nutrition, sleep, and training tracking
• Body fat estimation (Navy tape, BMI, skinfold)
• ISSN 2025 Position Stand-based recovery protocols

3. Eligibility

3.1 Age Requirements

To use MakeWeight, you must be:

• At least 13 years of age (enforced during profile setup per COPPA)
• If under 18, using the App with parental or coach consent and supervision

3.2 Health Considerations

You should consult a healthcare provider before using this App if you:

• Have an eating disorder or history of disordered eating
• Have been advised by a physician not to engage in weight cutting
• Have cardiovascular, kidney, or other conditions that contraindicate weight cutting
• Are pregnant or nursing

4. User Accounts

4.1 No Account Required

MakeWeight does not require account creation or authentication. All data is stored locally on your device. You agree to:

• Provide accurate information during profile setup
• Maintain the physical security of your device
• Accept responsibility for all data entered into the App

4.2 Account Termination

We may suspend or terminate your access if you:

• Violate these Terms
• Provide false information (particularly age or health data)
• Abuse the AI coaching features (e.g., attempting to extract harmful advice)

5. Subscriptions and Payments

5.1 Free and Pro Tiers

MakeWeight offers a free tier with core weight tracking, and a Pro subscription ("Season Pass") that unlocks AI coaching (up to 100 messages per month), meal plans, snap-a-meal photo food logging, and CSV data export.

• Monthly Plan: $29.99 per month
• Annual Plan ("Season Pass"): $199.99 per year (save ~44% versus paying monthly)

Prices shown in the App and on the App Store at the time of purchase are authoritative; Apple displays the current price before you confirm any purchase.

5.2 Subscription Terms

• Subscriptions are billed through Apple's App Store using StoreKit; payment is charged to your Apple ID at confirmation of purchase
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period, at the rate of the selected plan
• You can manage or cancel your subscription in iOS Settings > Apple ID > Subscriptions
• Refunds are handled by Apple per their refund policy

5.3 Free Trial

New subscribers to the annual Season Pass receive a 14-day free trial. Unless you cancel at least 24 hours before the trial ends, it automatically converts to a paid annual subscription billed to your Apple ID at $199.99/year. The monthly plan does not include a free trial. Any unused portion of a free trial is forfeited if you purchase a subscription before the trial ends.

5.4 Price Changes

We may change subscription prices. Apple will notify you of price changes, and you will have the opportunity to accept or cancel before the new price takes effect.

6. Acceptable Use

6.1 You Agree To:

• Use the App only for its intended purpose (wrestling weight management)
• Provide accurate personal and health information
• Consult healthcare professionals before making significant health decisions
• Follow all applicable athletic organization rules

6.2 You Agree NOT To:

• Use the App to pursue dangerously low weight targets below NCAA/NFHS minimum body fat floors
• Misrepresent your identity or age
• Attempt to circumvent safety warnings or guardrails
• Use the AI coach to generate advice for dangerous practices (saunas, rubber suits, diuretics, laxatives, extended fasting)
• Reverse engineer, decompile, or modify the App
• Share your account credentials with others
• Use automated systems to access the App or AI features
• Use the App to train competing AI systems

7. Health and Safety Disclaimers

7.1 Not Medical Advice

7.2 AI Coach Limitations

The AI coach feature is powered by Anthropic's Claude and provides evidence-based guidance within NCAA safety guidelines. However:

• The AI coach is not a doctor, registered dietitian, or licensed healthcare provider
• AI-generated advice should be verified by qualified professionals
• The AI may occasionally produce inaccurate information
• Meal plans are suggestions, not prescriptions

7.3 Inherent Risks of Weight Cutting

Weight cutting for wrestling involves inherent risks including but not limited to:

• Dehydration and electrolyte imbalances
• Impaired physical and cognitive performance
• Kidney stress and potential damage
• Cardiovascular complications
• Heat-related illness
• Growth and development issues in youth

7.4 Emergency Situations

If you experience any of the following, STOP all weight cutting activities and seek immediate medical attention:

• Chest pain or heart palpitations
• Difficulty breathing
• Confusion or disorientation
• Inability to urinate for 8+ hours
• Severe muscle cramps
• Fainting or near-fainting

7.5 User Responsibility

You acknowledge that:

• You use the App at your own risk
• You are responsible for your own health decisions
• The App's calculations are estimates based on published scientific formulas, not guarantees
• Individual responses to weight cutting vary significantly

8. Intellectual Property

8.1 Our Rights

The App and its original content, features, and functionality are owned by LabCabin LLC and protected by copyright and other intellectual property laws.

8.2 Your Rights

You retain ownership of any content you create within the App (logs, notes, photos). By using the App, you grant us a limited license to use this content solely to provide and improve our services.

9. Third-Party Services

9.1 Anthropic (Claude AI)

The App uses Anthropic's Claude AI for coaching and meal plan features. Your use of these features is subject to Anthropic's Terms of Service.

9.2 FatSecret Platform API

The App uses FatSecret for food search and barcode lookup. Your use of these features is subject to FatSecret's Terms of Use.

9.3 USDA FoodData Central

Food database searches may also use the USDA FoodData Central API, a free public government service, as a fallback.

9.4 Apple Services

The App uses HealthKit and StoreKit. Your use of these services is subject to Apple's Terms and Conditions.

10. Limitation of Liability

10.1 Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

10.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAKEWEIGHT SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, or use
• Any personal injury or health consequences resulting from weight management activities
• Any damages exceeding the total amount you paid for the App in the 12 months preceding the claim

11. Indemnification

You agree to defend, indemnify, and hold harmless LabCabin LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any injury or harm resulting from weight management activities

12. Termination

12.1 Your Right to Terminate

You may stop using the App at any time by uninstalling it. To cancel a subscription, manage it through iOS Settings > Apple ID > Subscriptions.

12.2 Our Right to Terminate

We may terminate or suspend your access immediately, without prior notice, for breach of these Terms.

12.3 Effect of Termination

Upon termination, your right to use the App ceases immediately. Since data is stored locally, uninstalling the App deletes all your data. Provisions that should survive termination (liability limitations, indemnification, dispute resolution) remain in effect.

13. Dispute Resolution

13.1 Informal Resolution

Before filing any legal claim, you agree to try to resolve disputes informally by contacting us at legal@makeweight.io.

13.2 Arbitration

Any disputes not resolved informally shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association.

13.3 Class Action Waiver

You agree to resolve disputes on an individual basis and waive any right to participate in class action lawsuits.

13.4 Exceptions

The following are NOT subject to arbitration: claims for injunctive relief, claims related to intellectual property, and claims eligible for small claims court.

14. General Provisions

14.1 Governing Law

These Terms shall be governed by the laws of the State of New Jersey, United States, without regard to conflict of law principles.

14.2 Severability

If any provision is found unenforceable, the remaining provisions continue in full effect.

14.3 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and MakeWeight.

14.4 Changes to Terms

We may update these Terms from time to time. We will update the "Last Updated" date and notify you of material changes through the App. Continued use constitutes acceptance.
